Introduction

The National Association of Boards of Pharmacy® (NABP®) or National Association of Boards of Pharmacy Foundation® (NABPF®) operates one or more websites (Website), such as www.nabp.pharmacy. NABP and NABPF are collectively referred to as “NABP.” Information about you may be collected through the Website. NABP may operate one or more software applications (App) that may collect information about you. The Website and App are collectively referred to as “Site.”

Information privacy and security are important to NABP, and NABP respects the personal information that you, as a user of the Site or NABP services, may share with us from time to time. This Privacy Policy (Policy) applies to user-identified information (Personal Information) that NABP may collect through the Site, affiliates, or products or services offered by NABP, with the exception of information collected or used through NABP’s background screening services. To learn more about NABP privacy practices in its preparation and processing of investigative consumer reports, please review the NABP Investigative Consumer Reporting Privacy Policy. NABP may amend this Policy at any time and at its sole discretion. NABP will post the amended Policy on the Site and will include the “Last Updated” date to reflect the effective date of the latest amendments. Your continued use of the Site following the posting of an amended Policy signifies your acceptance of the terms of the Policy as amended.

Information Collected

NABP offers many services (Services), including educational, informational, examination, accreditation, licensure, registration, promotional, and subscription Services. NABP may ask you to provide Personal Information to complete a transaction or may use Personal Information to deliver Services. For example, if you request to register for an examination or meeting, or if you request a subscription related continuing pharmacy education, NABP may collect Personal Information such as your name, email address, or payment information to complete the registration or subscription that you requested.

The types of Personal Information that may be collected include:

NABP may collect non-Personal Information during your visit to the Site. This information includes, but is not limited to, certain standard data that your browser sends to the Site such as your browser type and version, device type, language, access times, and the IP address of the website from which you arrived at the Site.

NABP may engage third-party service providers to support, provide, or administer Services, including the Site. These service providers may collect Personal Information on behalf of NABP or receive Personal Information from NABP. For example, NABP engages a third-party service provider that collects email addresses from individuals who subscribe to NABP e-News.

NABP might store some information on your computer hard drive in the form of a “cookie” to assist you with purchasing Services from NABP, to speed the log-in process, or to store information, such as personal preferences. Additionally, NABP’s third-party service providers may use information obtained through “cookies” for the purpose of evaluating your use of the Site, compiling reports on Site activity and Internet usage. You may refuse the use of cookies by selecting the appropriate settings on your browser. Please note, that if you refuse the use of cookies you may not be able to use the full functionality or Services of the Site.

When you pay for Services, credit card information may be collected by NABP through its Site, or you may be securely transferred from the Site to an NABP third-party service provider, which may collect your credit card information or other Personal Information for the purpose of processing your payment on behalf of NABP. Credit card information which is obtained by NABP through its Site is handled securely, in accordance with applicable laws and regulations, as well as payment card industry standards for such information.

Use of Personal Information

NABP uses Personal Information to deliver the Services you have requested, as you may permit from time to time, to contact you on behalf of boards of pharmacy, to contact you about your e-Profile, NABP account, or use of the Site, or for Association operations, including quality assurance purposes, to deliver to you information about NABP, or promotional activities.

Personal demographic and profile data may be used to tailor your experience at the Site, for example, to show you content you might be interested in.

NABP may use publicly available Personal Information about you for any purpose permitted under applicable law.

NABP may share your Personal Information with licensing agencies including, but not limited to, boards of pharmacy or pharmacy technician certification organizations if you are a certified pharmacy technician. For example, NABP may make your continuing pharmacy education data available to a board of pharmacy or pharmacy technician certification organization.

NABP may share your Personal Information with regulatory or law enforcement agencies as permitted or required by law.

NABP may disclose your Personal Information if required under the law or to comply with legal process, to protect or defend NABP rights, property, staff, or members, or the rights, property, or safety of others.

NABP may provide third-party service providers with your Personal Information for purposes of delivering the NABP Services you request, for third-party services that you may request, or to support, provide, or administer Services, including the Site. For example, NABP may provide your name, address, and phone number to our testing vendor if you request examination Services through the Site. NABP may provide your name and email address to a marketing organization to provide you with information about NABP Services.  Such third parties are required to protect your Personal Information in conformance with applicable state and federal laws. The privacy policy of such providers may apply to their use of your information. The provider’s policy may differ from this Policy, and you may wish to review the provider’s privacy policy or contact the provider directly for more information.

In the course of conducting Association business, NABP staff may access Personal Information for the purposes stated in this Policy. Staff are required to maintain the confidentiality of non-public Personal Information and are prohibited from unlawfully disclosing such information.

NABP may use or share de-identified data about users of the Site or Services for one or more purposes described in the Policy.

NABP does not sell Personal Information to third parties.

When your Personal Information is no longer needed, NABP disposes of it using methods to protect the security and confidentiality of the Information data, such as shredding, erasing, or rendering the Information to be unreadable.

Do Not Track Disclosures

NABP does not respond to users’ web browsers that communicate a “do not track” signal to the Site. The use of tracking technologies by third-party service providers on the Site is not covered by the Policy. These providers may use cookies or other methods to support their tracking technologies; however, NABP does not control these tracking technologies.

Correcting/Updating Information

You may request changes to Personal Information previously provided to NABP, or notify NABP of the preferred method by which NABP contacts you, by contacting NABP Customer Engagement via:

The Site may contain links to third-party websites that are not controlled by NABP. These third-party links are made available to you as a convenience, and you agree to use these links at your own risk. Please be aware that NABP is not responsible for the content or operations of third-party websites linked to NABP, nor is NABP responsible for the privacy policies or practices of third-party websites linked to the Site or NABP.

Security

NABP utilizes industry-standard measures to protect Personal Information under our control from misuse or unauthorized access. For example, NABP uses encryption technology to protect Personal Information that it collects through the Site; however, NABP cannot guarantee that these measures will fully protect the Personal Information. NABP will take all reasonable steps to protect the safety of your Personal Information.

Operations

Our Site and the servers that make the Site available world-wide are located in the United States. The laws of the US govern all matters relating to and all transactions involving the Site. Any information you provide in registering or purchasing goods or Services from NABP will be transferred to the US. By visiting the Site and providing information to NABP through your use of the Site, you authorize this transfer, processing, and use of information.

Conflict

If there is a conflict between the terms of this NABP Privacy Policy and the Investigative Consumer Reporting Privacy Policy, the terms of this NABP Privacy Policy control with respect to the Services described in this Policy. Agreement with Privacy Policy

By using Services or logging onto or using the Site, you signify your agreement to the terms of the Policy and any modifications thereof and that you release and hold harmless NABP, its members, directors, officers, employees, contractors, and affiliates from any and all claims arising from information that you provide or transmit to NABP or the Site in an unsecured manner.

Your use of the Site is governed by the Policy and the Terms of Use.

NABP Biometric Information Policy

The National Association of Boards of Pharmacy® (NABP®) owns, develops, and administers various examinations, including the North American Pharmacist Licensure Examination (NAPLEX®), the Multistate Pharmacy Jurisprudence Examination® (MPJE®), and Foreign Pharmacy Graduate Equivalency Examination®. Boards of pharmacy of the United States use two or more of these examinations to determine if a candidate has met the educational requirements for pharmacist licensure. Because an individual may attempt to engage in fraud on one or more of NABP’s examinations, the Association takes significant steps to help ensure the security and integrity of its examinations.

A key NABP security measure addresses accurately identifying examination candidates to help detect and prevent examination fraud across Association exams. Examination fraud includes, without limitation, individuals who take, or attempt to take, an examination for another individual or who take an examination without NABP or board of pharmacy authorization (for example, to access or memorize test questions for disclosure or sale to others). Palm vein scanning technology is used by NABP and the NABP test administration vendor, Pearson VUE and its contractors, as one method to deter and detect examination fraud. The purpose of this policy is to comply with applicable law and inform NABP examination candidates how palm vein scans are collected, retained, and permanently destroyed in accordance with applicable law.

Notice & Consent

NABP provides information about the collection of palm vein scans in its candidate application bulletins for NABP examinations and in this policy. When candidates arrive at the Pearson VUE testing center to check-in for an NABP examination, they are provided with information about the collection of palm vein scanning and are asked to read and sign an agreement consenting to the collection of their palm vein scan.

Collection

After candidates sign the consent agreement, the examination check-in process at the Pearson VUE testing center includes the collection of candidates’ palm vein scans. Candidates place their hand on a device containing a sensor with palm vein technology. This device scans veins in each candidate’s palm using a safe near-infrared light source like that in a television remote control. Each time a candidate takes a break from the examination, their palm is scanned when returning to the testing room and the results are compared to the candidate’s original scan to verify their identity. When a candidate takes an NABP examination at a later date, one or more palm vein scans are collected from the individual and are subject to comparison with the original scan and other candidate palm vein scans. After a candidate finishes taking an NABP examination, the test results and palm vein scans are sent to Pearson VUE via encrypted transmission, are securely stored, and palm vein scans are disposed of as described in this policy.

Purpose and Use

The purpose for collecting an individual’s palm vein scan is to detect and prevent fraud in connection with NABP examinations. An initial palm vein scan is collected by Pearson VUE to create a template for that individual and compare it to one or more palm vein scans that are collected 1) during the same testing session (eg, when an individual returns to the testing room after a break) and 2) when administering subsequent examinations (eg, an individual who re-takes an examination after previously failing, or an individual who passed the NAPLEX and who later takes the MPJE test as may be required for pharmacist licensure). NABP may perform comparisons among a candidate’s palm vein scans that are collected after the original scan or may compare a candidate’s palm vein scans to those of other candidates to identify individuals who may have tested under multiple names or identities. NABP may use palm vein scans to protect or defend NABP’s rights, property, staff, or members, or the rights, property, or safety of others to the greatest extent permitted under applicable law.

Retention and Destruction

Palm vein scans and information based on or derived from the scans are retained for three years after the candidate successfully passes the FPGEE, NAPLEX, or MPJE examination or three years after the candidate’s last interaction with NABP, whichever occurs first, unless otherwise required or permitted by law. Palm vein scans and information based upon or derived from the scans are permanently destroyed following expiration of the applicable retention period described in this policy.

Disclosure

Pearson VUE, its contractors, and NABP do not sell, lease, trade, or profit from palm vein scans or information based on or derived from these scans.

Pearson VUE, its contractors, and NABP do not disclose, redisclose, or disseminate palm vein scans or information based on or derived from these scans unless an individual consents to disclosure or redisclosure; disclosure or redisclosure is required by state or federal law or municipal ordinance; or disclosure or redisclosure is required by valid warrant or subpoena issued by a court of competent jurisdiction.

Storage and Transmission

Pearson VUE and/or its contractors store, transmit, and protect from disclosure palm vein scans and related data using a reasonable standard of care within the industry, but in no event in a manner that is less protective than how Pearson VUE or its contractors store, transmit, or protect from disclosure its other confidential or sensitive information.

NABP does not receive, store, or transmit palm vein scans or related data except if there is an issue or concern about candidate-involved examination fraud as described in this policy. If such an issue or concern arises, NABP may receive, store, or transmit palm vein scans or related data, in which case NABP will protect the scans and related data from disclosure using a reasonable standard of care within the industry, but in no event in a manner that is less protective than how NABP stores, transmits, or protects from disclosure its other confidential or sensitive information.

Policy Statement

NABP may revise this policy from time to time. If any provision of this policy is held unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this policy and shall not affect the validity and enforceability of any remaining provisions. Investigative Consumer Reporting Privacy Policy

NABP respects the privacy of your personal data. We use encryption and other technologies and practices to secure your data. Our Investigative Consumer Reporting Privacy Policy (Policy) describes how we may collect, use, and safeguard your personal information.

This Policy applies to information about you that is collected or used in connection with investigative consumer reporting services (Services). These Services are commonly known as background checking services. NABP offers Services to employers, other entities engaging your services, or you. The Services include verification of professional licensure, registration, credentials, pharmacy education, employment data, and regulatory or law enforcement discipline or sanctions. The NABP Verify program uses the Services. 

This Policy does not apply to collection or use of your information related to any other program or service that NABP may offer, such as examination services.   

Information Collected 

Sources

NABP may collect your personal data via any means, whether online, electronic, verbal, or written. We may collect information about you from your employer or prospective employer or an organization that may engage you as a contractor or volunteer. We may collect personal data from you. We may collect information about you from public sources, regulators such as a board of pharmacy or its website, or other sources such as a pharmacy technician certification organization. Your personal data may have been previously provided to or obtained by NABP. For example, you may have already created an NABP e-Profile and added personal data so you can track your continuing pharmacy education. NABP may collect additional or clarifying information about you or maintain personal data as described in this Policy.

Types

The types of data about you (Personal Data) that may be collected or obtained, or that were previously collected or obtained, include, but are not limited to, the following:

Use of Personal Data

NABP uses Personal Data to process requests for background checks. 

To perform and process a background check, NABP may need to share your Personal Data with third parties such as employers, potential employers, organizations that may engage you as a contractor or volunteer, regulators, law enforcement, data furnishers, and others as permitted by law.

NABP may use your Personal Data to answer questions or communicate with you, employers, other organizations requesting a background check, or third parties assisting NABP in providing the Services.

Personal Data is used as permitted and in compliance with the Fair Credit Reporting Act (FCRA) and related state laws.

NABP may use your Personal Data as required by federal or state law, court orders, or legal process.

NABP does not sell or rent Personal Data to third parties.

Security and Confidentiality

In the course of providing Services, NABP staff may use or access Personal Data for the purposes stated in this Policy. Staff are required to maintain the confidentiality of Personal Data and are prohibited from unlawfully using or disclosing such Data. 

NABP protects the security and confidentiality of your Personal Data by requiring a login, password, and two-factor authentication to provide Personal Data to NABP or access background check reports online. Secure socket layer and encryption technologies safeguard the transmission of Personal Data through the NABP website. Internal and external firewalls are used to protect Personal Data held by NABP. Additionally, administrative and physical security measures are in place to prevent unauthorized access to Personal Data.

Personal Data Disclosure: United States or Overseas

NABP does not transfer Personal Data to third parties outside the United States or its territories for purposes of the Services. Personal Data submitted to NABP for background investigations is not transferred outside of the United States. The collection and processing of Personal Data for background investigations are performed in the United States.
