Information Sharing Policy

This policy outlines the circumstances when NABP may share information about an inspection Applicant or accreditation Applicant or Accredited Entity. 1

Applicant/Accredited Entity information not already in the public domain is considered confidential and protected by NABP but may be used in limited instances.

Applicant information (Information) is defined as documentation, materials, or any other information that Applicant/Accredited Entity provides or has previously provided to NABP or that NABP otherwise acquires or has previously acquired about Applicant/Accredited Entity, including, without limitation, application documentation, inspection, onsite inspection or survey, compliance reviews, and e-Profile data.

NABP and its employees and contractors do not use or disclose Information without Applicant/Accredited Entity’s written consent except as permitted under this policy and as required by Applicable Law.

  1. NABP may use Information internally for any purpose.
  2. NABP may use de-identified Information for any purpose.
  3. NABP may disclose Information as required by Applicable Law.
  4. NABP may make available Information at any time to Applicant/Accredited Entity’s regulators upon their request or if NABP believes in good faith that Applicant/Accredited Entity or its trading partners are or have engaged in conduct that violates the law or there is a serious or imminent threat to public health.
  5. NABP may make available Information to law enforcement agencies, local or federal, if NABP believes in good faith that Applicant/Accredited Entity or its trading partners are or have engaged in conduct that violates the law.
  6. NABP may disclose Information to verify that another Applicant/Accredited Entity complies with Program Standards or applicable law limited as follows:
    • Supply chain or product sourcing;
    • Distribution or dispensing practices; or
    • Affiliate, Affiliate Business or ownership interest.
