Drug Enforcement Administration (DEA) has issued a notice of intent to schedule 7-hydroxymitragynine (7-OH) and three related substances in Schedule I of the Controlled Substances Act (CSA). The temporary scheduling order was issued after the United States Department of Health and Human Services determined that highly concentrated, synthetic 7-OH creates a risk for misuse and has no accepted medical use. Botanical kratom products, and other products that have 7-OH below the specific threshold, are not subject to this scheduling order. Individuals who manufacture, distribute, and sell 7-OH substances listed in Schedule I of the CSA may potentially face criminal, civil, and administrative penalties.
